1. Preamble

1.1. Admiral Sportwetten GmbH, FN 39714d, Novomatic Straße 5, 2352 Gumpoldskirchen, (hereinafter referred to asthe ‘Organiser’ or**‘ASW’), offers an attractive welcome offer for new customers through the ‘Start Bonus Programme’ (hereinafter referred to as the‘Bonus Programme’**). The aim of this programme is to give (new) customers the opportunity to immerse themselves in the world of betting and to broaden their initial experience with betting as a product.

1.2. These terms and conditions of participation govern the rights and obligations of participants within the framework of the Bonus Programme and ensure transparent and fair administration. By participating in the bonus programme, the participant agrees to these terms and conditions and acknowledges the need to comply with them in order to uphold the legal framework and integrity of the programme.

2. Eligibility

2.1. These terms and conditions are binding on all persons wishing to take part in the ‘Start Bonus Programme’. Only natural persons of legal age (at least eighteen [18] years old) resident in Austria are eligible to participate. Participation is restricted to new customers who havenot previously heldan account and are registering one for the first time.

2.2. By registering with ASW, the participant undertakes to provide complete, up-to-date, accurate and truthful personal details. This includes, in particular but not exclusively, their full name, date of birth, address, email address and telephone number. The participant shall notify ASW of any changes to this information without being asked. The participant is responsible for ensuring that this information is accurate and up to date.

2.3. The organiser reserves the right to verify the participant’s identity by appropriate means. This includes, amongst other things, requesting additional documents for verification, such as photo ID or proof of address.

2.4. In the event of incorrect, out-of-date or incomplete details, the organiser reserves the right to exclude the participant from the bonus programme, to cancel the bonus and any resulting winnings, and to take legal action where necessary.

2.5. Each individual is only entitled to participate in the bonus programme once. Participation is limited to a single ASW customer account per person, email address, payment method and device. Multiple entries, in particular through the use of multiple customer accounts, are expressly prohibited and will result in exclusion from the bonus programme. Sharing the customer account or its use by anyone other than the registered customer is prohibited and will also result in exclusion from the bonus programme.

2.6. Employees of ASW and their dependants are excluded from participation. Furthermore, employees of affiliated companies are excluded from participation. The term ‘dependants’ also includes those persons who share the same place of residence and therefore the same postal address.

3. Eligibility

3.1. Participation in the bonus programme begins on 29 October 2019 and ends on 31 December 2026 (midnight).

3.2. Participants may only claim the bonuson the website as registered users.

4. Content and administration of the bonus programme

4.1. The bonus under the bonus programme is only available upon initial registration and verification of an account with ASW, as well as a first real-money deposit of at least EUR 20.00 (in words: twenty euros and zero cents). For the first deposit, the deposit transaction must be successfully processed before the bonus amount is credited to the participant’s customer account, and it can only be activated in conjunction with the initial deposit. The following standard payment methods are permitted for deposits, provided they meet the organiser’s requirements and are used to ensure a secure transaction.

4.2. The deposit must be made online or via mobile using the participant’s betting account. Manual bank transfers (e.g. using a payment slip), cash deposits and deposits made via Skrill are excluded from this bonus programme.

4.3. Following registration and successful account verification, the bonus amount will be awarded depending on the amount of the participant’s deposit. The maximum bonus amount is 100% of the first deposit amount (up to a maximum of EUR 200,-- [in words: two hundred euros and zero cents]).

4.4. The bonus is activated automatically following the first deposit, provided that the deposit meets the specified requirements of the bonus programme.

4.5. The bonus amount is credited to the customer’s account immediately and is then available for betting. The bonus is subject to the terms and conditions of the bonus programme (see point 5) and must be wagered within the specified time limits before the first withdrawal of the bonus amount can be made.

5. Bonus terms and conditions and fulfilment

5.1. The bonus amount is credited to the participant’s account following the first successful deposit and is subject to certain conditions. These are as follows:

5.1.1. Depending on the real-money deposit in accordance with clause 4.3, the participant will receive a bonus amount. The amount deposited in real money and the bonus amount as per clause 4.3 are added together and the result is multiplied by five (5), thereby determining the required total turnover.

5.1.2. In order to withdraw the bonus amount as real money, the participant must place bets at odds of at least 1.90.

5.1.3. Regardless of the outcome of the bet, the stake will be deducted from the required total turnover, provided that a bet is placed at odds of at least 1.90. If the total amount specified in clause 5.1.1 is fully reached through stakes placed at odds of at least 1.90 per bet, the bonus amount may be withdrawn. During the bonus programme, the participant will be informed by a progress bar (see point 5.2.) ofhow close they are to meeting the conditions.

5.1.4. In the event of a win from a successful bet with odds of 1.90 or higher, the stake (consisting of real money and the bonus amount) is multiplied by the odds shown on the betting slip. Provided that (i) the participant stakes an amount (consisting of real money and the bonus amount), (ii) places a bet at minimum odds of 1.90 or higher, and (iii) the bet is successful (‘win’), the bonus amount may continue to increase during the bonus programme period (on an ongoing basis).

5.1.5. However, should the bonus amount staked (excluding real money) be lost in full on a single bet, there will be no further multiplication or accumulation of the amount as set out in clause 5.1.4.

5.1.6. Single, system and accumulator bets are all permitted for the purposes of fulfilling these conditions. If several different types of bet, such as single bets, system bets, multi-way bets and/or combination bets, and/or events, such as sporting events (e.g. football or basketball), are placed on a single betting slip, these are collectively regarded as a single bet. Otherwise, an entire accumulator bet or a system bet is treated as a single bet.

5.1.7. If several betsare placed on the same event, only the bet placed first in chronological order will be taken into account for the purposes of these bonus terms and conditions. Any subsequent bets placed on the same event or occasion will not be taken into account for the purposes of fulfilling these bonus terms and conditions.

5.1.8. Only settled bets and events (e.g. sporting events) that meet these terms and conditions will count towards the required total turnover as set out in clause 5.1.1.

5.2. To facilitate tracking, a progress bar is made available to the participant, which indicates when the conditions for the payout of the bonus amount have been met.

5.3. The participant has a period of ninety (90) days from the date the bonus amount is credited to fully meet the relevant bonus conditions. If the required total turnover as set out in clause 5.1 is not achieved within this period through bets placed at odds of at least 1.90, the bonus will automatically lapse and can no longer be claimed.

5.4. The participant is permitted to actively use more than one bonus with ASW at the same time. These are visible in their betting account. The participant may, at their discretion, terminate the bonus programme in their betting account.

5.5. The bonus cannot be converted into other bonus offers or promotions from ASW and may only be used in accordance with the specific terms and conditions of the current bonus programme.

5.6. Participants cannot distinguish between the real money deposited and the bonus amount. Both amounts are shown as a single total in the customer account. For further information and to clearly distinguish between the categories, please note that the relevant customer account can be viewed in detail. When placing a bet, the stake is used in the following order:
1. Bonus balance
2. AML-restricted real money balance
3. Unrestricted real money balance

5.7. Until the relevant bonus conditions have been fully met, the participant’s real money balance is subject to withdrawal restrictions up to the amount of the deposit qualifying for the bonus. Withdrawal of any real money balance won is possible at any time. If the participant cancels or terminates their bonus via their betting account (see section 5.4.), this lifts the withdrawal restriction on the deposit amount eligible for the bonus. Any real-money balance exceeding the amount subject to withdrawal restrictions remains unaffected by this provision and may be withdrawn without restriction, subject to the relevant provisions of ASW’s General Terms and Conditions and Betting Rules.

6. Exclusion from participation and misuse

6.1. Participation in the bonus programme requires the participant to behave in a manner that complies with these terms and conditions and ensures the smooth running of the bonus programme. Any attempt to circumvent the terms and conditions or to abuse the bonus programme will be regarded by the organiser as a serious breach of these terms and conditions. The organiser reserves the right to take all necessary measures to protect the integrity of the bonus programme and to ensure that all participants comply with the stipulated terms and conditions.

6.2. The following actions shall in any event be deemed to constitute abuse within the meaning of clause 6.1 and shall result in exclusion from the bonus programme:

6.2.1. Multiple registrations: The registration of multiple accounts by a single person using different identities, email addresses, payment methods or devices is prohibited and constitutes a serious breach of the terms and conditions of participation.

6.2.2. Use of technical aids: The use of technical aids, programmes or other attempts at manipulation to obtain unlawful bonuses is deemed to be abuse. This includes, in particular, the use of software designed to conceal or manipulate the participant’s IP address in order to gain an unlawful advantage.

6.3. Should any abuse be detected, the organiser reserves the right to impose the following sanctions:

6.3.1. The participant will be immediately excluded from the bonus programme.

6.3.2. The participant’s customer account may be suspended without prior notice.

6.3.3. All bonuses and winnings resulting from such abusive activities will be cancelled.

6.4. The organiser reserves the right, in the event of serious breaches, to take further legal action to assert its claims and ensure the integrity of the bonus programme is protected.

7. Limitation of liability

7.1. The organiser accepts no liability for technical faults, delays, outages or other restrictions on the platform, in particular www.admiral.at, which are beyond its control and which may impair or prevent participation in the bonus programme. Similarly, the Organiser is not liable for any losses or damages resulting from such technical problems.

7.2. The organiser’s liability is limited to cases of wilful misconduct and gross negligence (excluding cases of fraudulent intent and personal injury (injury to life, limb or health)). The organiser shall not be liable for damage caused by slight negligence. Furthermore, liability for loss of profit, indirect damage, consequential damage arising from defects, and claims by third parties is excluded.

8. Data Protection

8.1. ASW’s data protection provisions, which are availableon the website www.admiral.at,apply. The participant has the right at any time to obtain information about the data stored and may request its deletion or correction, insofar as this is permitted by law.

9. Contact and Complaints

9.1. Any participants who have questions or complaints regarding the bonus programme may contact customer services. The organiser will endeavour to process and respond to enquiries and complaints within a reasonable period of time.

10. Severability clause

10.1. Should any individual provision of these Terms and Conditions be wholly or partially invalid, unlawful or unenforceable, this shall not affect the validity of the remaining provisions. The invalid, unlawful or unenforceable provision shall be replaced by a valid, lawful and enforceable provision that comes as close as possible to the economic purpose of the original provision.

11. Applicable law and jurisdiction

11.1. These Terms and Conditions of Participation shall be governed exclusively by the law of the Republic of Austria, to the exclusion of conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

12. Right to make changes

12.1. The organiser reserves the right to amend the bonus programme, including these terms and conditions, at any time, to terminate it early or to suspend it temporarily. This applies regardless of the circumstances and without prior notice.

12.3. In the event of any contradiction or conflict between ASW’s terms and conditions as set out in clause 12.2 and the terms and conditions of the bonus programme, the terms and conditions of the bonus programme shall take precedence. In such cases, the terms and conditions of participation shall take precedence and shall be decisive in determining the relevant matter.
