1.     Introduction

1.1.    Admiral Sportwetten GmbH, FN 39714d, Novomatic Straße 5, A-2352 Gumpoldskirchen (referred to below as the 'organiser' or 'ASW') offers new customers an appealing welcome offer in the form of a newcomer bonus programme (referred to below as the 'bonus programme'). The purpose of this programme is to give newcomers the opportunity to immerse themselves in the world of sports betting and broaden their initial experience with the sports betting product.

1.2.    These terms and conditions of participation set out the rights and obligations of participants in the context of the Bonus Programme and ensure the process is transparent and fair. Participants of the bonus programme agree with these terms and conditions of participation and acknowledge that they must be complied with in order to preserve the legal framework and integrity of the programme.

2.     Eligibility to participate

2.1.    These terms and conditions of participation apply to any person wishing to participate in the newcomer bonus programme. Only natural persons of legal age (at least eighteen (18) years old) who reside in Austria are eligible to participate. Participation is limited to new customers who have not previously held an account with ASW at www.admiral.at and are registering for the first time.

2.2.    By registering with ASW, participants undertake to provide complete, up to date, accurate and truthful information about themselves. This includes, but is not limited to, submission of the full name, date of birth, address, email address, and telephone number. Participants shall inform ASW of any changes to their information without being prompted. Participants are responsible for ensuring this information is accurate and up to date.

2.3.    The organiser reserves the right to verify the identity of participants by appropriate means. This includes requests for additional documents for verification, such as photographic ID or proof of address.

2.4.    The organiser reserves the right to bar participants who submit information that is false, outdated or incomplete from the bonus programme, to cancel the bonus and all resulting winnings, as well as to initiate legal proceedings if necessary.

2.5.    Each natural person is only entitled to participate in the bonus programme once. Participation is limited to a single ASW customer account per person, email address, payment method and device. Multiple instances of participation, in particular by means of several customer accounts, is expressly prohibited and will result in exclusion from the bonus programme. Transferring the customer account or allowing its use by persons other than the registered customer is prohibited and will also lead to exclusion from the bonus programme.

2.6.    Staff of ASW and their relatives are excluded from participation. Staff of affiliated companies are also excluded from participation. The term 'relatives' includes any person who shares the same residence and, therefore, the same postal address.

3.     Opportunity to participate

3.1.    Participation in the bonus programme begins on 29 October 2024 and ends at midnight on 31 December 2024.

3.2.    Participants can only claim the bonus as a registered user on ASW's website.

4.     Content and implementation of the bonus programme

4.1.   The bonus from the bonus programme is only available upon the initial registration and verification of an account with ASW and a first real-money deposit of at least EUR 20.00 (in words: twenty euro and zero cent). When the first deposit is made, the deposit process must be successfully completed before the bonus amount is credited to the participant’s customer account and it can only be activated in conjunction with the first deposit. Only commonly accepted payment methods that meet the organiser’s requirements and ensure the transaction is secure are permitted for the deposit.

4.2.    The deposit must be made online or by mobile device via the participant's betting account. Manual bank transfers (e.g. by means of a paying-in slip), cash deposits and deposits with Skrill are excluded from this bonus programme.

4.3.    After registration and successful account verification, the bonus amount will be granted based upon the participant’s deposit amount. The maximum bonus amount is 100% of the first deposit amount (EUR 200 maximum – in words: two hundred euro and zero cent).

4.4.    The bonus is activated automatically after the first deposit if the deposit meets the bonus programme's specified requirements.

4.5.    The bonus amount will be credited to the customer's account immediately and is then available for sports betting. The bonus is subject to the terms and conditions of the bonus programme (see Clause 5.) and must be wagered within the specified timeframe before a first payout of the bonus amount can be made.  

5.     Bonus conditions and compliance

5.1.    The bonus amount will be credited to the participant's account after the first successful deposit has been made and is subject to certain conditions:

5.1.1.   The participant receives a bonus amount based upon the real-money deposit according to Clause 4.3. The real-money deposit amount and the bonus amount according to Clause 4.3. are added together and the result is then multiplied by five (5) to determine the total sales required.

5.1.2.   To withdraw the bonus amount in the form of real money, the participant must place sports bets at odds of at least 1.90.

5.1.3.   Regardless of the outcome of the bet, the stake will be deducted from the required total sales if a sports bet is placed with odds of at least 1.90. If the total amount according to Clause 5.1.1. is reached in full through bets placed at odds of at least 1.90, then the bonus amount can be withdrawn. During the course of the bonus programme, a progress bar (see Clause 5.2.) notifies participants of how close they are to complying with the conditions.

5.1.4.   If a sports bet placed at odds of 1.90 or higher is successful and produces a win, then the stake (comprising real money and the bonus amount) is multiplied by the odds shown on the betting slip. If (i) the participant wagers an amount (comprising real money and the bonus amount), (ii) places a sports bet at the minimum odds of 1.90 or higher, and (iii) the sports bet is successful, i.e. produces a win, then the bonus amount can continue to accumulate during the course of the bonus programme.

5.1.5.   However, if the full bonus amount wagered (excluding real money) is lost on a sports bet, then no further multiplication and accumulation of the amount within the meaning of Clause 5.1.4. will take place.

5.1.6.   For compliance with the applicable conditions, single, system, and accumulator sports bets are permitted. If several different types of sports bet, such as a single bet, system bet, multi-way bet and accumulator bet, and/or sports events, such as football or basketball, are placed on a single betting slip, then they are considered to be a single sports bet. Otherwise, an accumulator bet as well as a system sports bet will be regarded as a single sports bet.

5.1.7.   Only completed sports bets and sports events that comply with these conditions will count towards the total sales required according to Clause 5.1.1.

5.2.    To make it easier for participants to track their progress, a progress bar that shows them when the conditions for withdrawing the bonus amount have been met has been provided.

5.3.    Participants have a period of ninety (90) days from when the bonus amount is credited to fully comply with the applicable bonus conditions. If the required total sales according to Clause 5.1. are not reached within this timeframe by means of sports bets placed at odds of at least 1.90, then the bonus expires automatically and can no longer be claimed.

5.4.    Participants are permitted to use more than one bonus from ASW at the same time. The bonuses are visible in their betting account. Participants may terminate the bonus programme at any time via their betting account.

5.5.    The bonus cannot be converted into other bonus offers or promotions from ASW and may only be used in accordance with the applicable conditions of the current bonus programme.

5.6.    Participants cannot differentiate between real money that has been deposited and the bonus amount. Both amounts are summarised in the customer account. Only the real money that has been deposited is used first. For further information and to clearly differentiate between real money and the bonus amount, participants are advised to review their account details.

5.7.    Withdrawal of the participant's real money balance remains restricted up to the amount of the deposit qualifying for the bonus until the applicable bonus conditions have been met in full. The withdrawal of any real-money winnings is possible at any time. If participants clear or terminate their bonus via their betting account (see Clause 5.4.), then the restriction on withdrawals up to the amount of the deposit qualifying for the bonus ceases to apply. Any real-money balance exceeding the aforementioned restricted amount is not affected by this provision and may be withdrawn unrestricted in accordance with ASW's general terms and conditions of business and betting provisions.

6.    Improper use and exclusion from participation

6.1.    Participation in the bonus programme is subject to participants acting in accordance with the applicable terms and conditions, as well as in a manner that ensures it runs smoothly. The organiser will treat any attempt to circumvent the terms and conditions or use the bonus programme improperly as a serious violation of these terms and conditions. The organiser reserves the right to take any measures needed to protect the integrity of the bonus programme and ensure that all participants comply with its terms and conditions.

6.2.    The following acts shall always be treated as improper use within the meaning of Clause 6.1. and result in exclusion from the bonus programme:

6.2.1.   Multiple registrations: The registration of multiple accounts by one person using different identities, email addresses, payment methods or devices is prohibited and constitutes a serious breach of the terms and conditions of participation.

6.2.2.   Use of technical aids: The use of technical aids, software or other attempts at manipulation to unlawfully obtain a bonus will be treated as improper use. In particular, this includes the use of software designed to obscure or manipulate the participant's IP address so as to gain an unlawful advantage.

6.3.     The organiser reserves the right to impose the following penalties if improper use is detected:

6.3.1.   Participants will be immediately excluded from the bonus programme.

6.3.2.   The participant's customer account may be blocked without prior notice.

6.3.3.   All bonuses and winnings resulting from such improper use will be declared invalid.

6.4.    In the event of serious violations, the organiser reserves the right to take further legal action to assert its claims and ensure that the integrity of the bonus programme is protected.

7.     Limitation of liability

7.1.    The organiser cannot accept liability for technical malfunctions, delays, outages or other restrictions in the platform, in particular www.admiral.at, which are outside its control and which may affect or prevent participation in the bonus programme. Moreover, the organiser is also not responsible for any losses or damage resulting from such technical problems.

7.2.    The organiser's liability is limited to wilful and grossly negligent behaviour (excluding cases of fraud and personal injury (injury to life, limb or health)). The organiser cannot accept liability for damages caused by minor negligence. Liability for loss of profit, indirect damages, consequential damages and third-party claims is also excluded.

8.     Privacy

8.1.    ASW's privacy policy applies and can be accessed on the website at www.admiral.at . Participants have the right to obtain information about stored data at any time and can request its erasure or correction where legally permissible.

9.    Contact and complaints

9.1.    All participants who have questions or complaints about the bonus programme may contact ASW's customer service team. The organiser will make every effort to process and respond to inquiries and complaints within a reasonable timeframe.

10.   Severability

10.1.  Should any provision of these terms and conditions of participation be wholly or partially invalid, unlawful, or unenforceable, the validity of the remaining provisions shall not be affected. The invalid, unlawful or unenforceable provision shall be replaced by one that is valid, lawful, enforceable, and most closely matches the economic purpose of the original provision.

11.   Applicable law and jurisdiction

11.1.  These terms and conditions of participation are subject to the law of the Republic of Austria, exclusively, to the exclusion of any conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.

12.   Reservation of the right to modify

12.1.  The organiser reserves the right to modify, terminate early or temporarily suspend the bonus programme and its terms and conditions of participation at any time. This applies regardless of the circumstances and without prior notice.

12.2.   ASW's general terms and conditions of business and betting provisions apply.

12.3.  The bonus programme's terms and conditions of participation shall take precedence in the event of any contradictions or conflicts between the provisions of ASW according to Clause 12.2. and the bonus programme's terms and conditions of participation. In such cases, the terms and conditions of participation shall prevail and govern the respective matter.
